Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the BritishText website at britishtext.com and the BritishText messaging platform at app.britishtext.com (collectively, the “Service”), operated by BritishText Ltd (“BritishText”, “we”, “us”, or “our”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the Service. If you are using the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.

1. Account Terms

  • You must be at least 18 years of age to use the Service.
  • You must provide accurate, current, and complete information when registering for an account and keep it up to date.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
  • You must notify us immediately at support@britishtext.com if you suspect any unauthorised use of your account.
  • You may not use the Service if you are a direct competitor of BritishText without our prior written consent.
  • One person or legal entity may not maintain more than one free trial account.

2. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not use the Service to:

  • Send unsolicited commercial communications (spam) or messages that violate the Privacy and Electronic Communications Regulations 2003 (PECR)
  • Send messages to recipients who have opted out or asked not to be contacted
  • Transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or obscene
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity
  • Transmit any unsolicited bulk messages, chain letters, or pyramid schemes
  • Engage in any form of phishing, smishing, or fraudulent activity
  • Harvest or collect personal data without proper legal basis and consent
  • Use the Service in any manner that could overburden or impair the infrastructure
  • Attempt to gain unauthorised access to any part of the Service or related systems
  • Violate any applicable local, national, or international law or regulation

PECR compliance: You are solely responsible for ensuring that all messages sent through BritishText comply with PECR, including but not limited to obtaining valid consent, providing clear identification of the sender, and honouring opt-out requests. BritishText provides tools to help with compliance but the legal responsibility remains with you.

3. Payment Terms

  • Subscription fees are billed monthly in advance on the date you subscribe. All prices are in GBP and exclude VAT.
  • VAT will be charged at the applicable rate where required by law.
  • Add-on charges (additional SMS, extra seats, etc.) are billed monthly in arrears based on actual usage.
  • Payments are processed by our third-party payment provider. By providing payment details you authorise us to charge the applicable fees.
  • If a payment fails, we will attempt to retry and notify you by email. Continued non-payment may result in suspension of your account.
  • All fees are non-refundable except where required by law or as expressly stated in these Terms.
  • We reserve the right to change our pricing with 30 days' prior written notice.

4. Free Trial

BritishText offers a 7-day free trial with 50 SMS credits included. No credit card is required to start the trial. At the end of the trial period, your account will revert to a limited free tier unless you upgrade to a paid plan. Trial accounts are limited to one per person or legal entity. We reserve the right to modify or discontinue the free trial at any time.

5. Service Availability

We aim to provide the Service with 99.9% uptime, excluding scheduled maintenance. Scheduled maintenance will be notified in advance where possible.

We do not guarantee that the Service will be available at all times without interruption. We will not be liable for any losses or damages arising from downtime, provided we have taken reasonable measures to maintain the Service. Delivery of SMS messages is subject to the capabilities and availability of network operators and is not guaranteed.

6. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of BritishText Ltd and its licensors. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.

You retain ownership of any content you upload or transmit through the Service. By using the Service you grant BritishText a limited licence to process and store your content solely to provide the Service.

7. Limitation of Liability

To the maximum extent permitted by applicable law, BritishText and its directors, employees, agents, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, goodwill, or business interruption, arising out of or in connection with these Terms or your use of the Service.

Our total aggregate liability to you for any claim arising under or in connection with these Terms shall not exceed the total amount paid by you to BritishText in the 12-month period preceding the event giving rise to the claim, or £100, whichever is greater.

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

8. Indemnification

You agree to indemnify, defend, and hold harmless BritishText and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, costs, and expenses (including reasonable legal fees) arising out of your use of the Service in violation of these Terms, your violation of any applicable law or regulation, or any content you transmit through the Service.

9. Termination

You may cancel your account at any time from within your dashboard settings or by emailing support@britishtext.com. Cancellation takes effect at the end of your current billing period. No refunds are issued for unused portions of a billing period.

We reserve the right to suspend or terminate your account immediately, without prior notice, if:

  • You breach these Terms, particularly the Acceptable Use provisions
  • We are required to do so by law or a regulatory authority
  • You engage in activity that may expose BritishText or its users to legal liability
  • Your account remains unpaid for more than 14 days after the due date

Upon termination, your right to use the Service will cease immediately. You may request export of your data within 30 days of termination, after which we may delete your account data.

10. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or in connection with these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Before commencing any formal dispute proceedings, you agree to attempt to resolve the dispute informally by contacting us at support@britishtext.com. We will attempt to resolve the dispute within 30 days.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice of material changes by emailing the address associated with your account and by posting a notice on the Service. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.
